These general terms and conditions of sale apply to all orders and sales transactions on www.tayojewelry.com.

By placing an order on the website, you confirm that you agree to and accept these terms and conditions as laid out by TAYO Jewelry.

(General Note)
TAYO Jewelry cannot be held responsible for any damage to the package or loss of the package during shipment.

(Product Information)
All TAYO Jewelry is handcrafted in Belgium and is available in sterling silver and gold-plated sterling silver or, upon special request, in 18K gold. However, the colors in pictures and the actual product may differ due to settings and various types of hardware.

(Availability)
Since every item in the e-shop is made-to-order, it takes approximately 3-4 weeks between the order and the delivery of the package. For specific requests and custom jewelry pieces, the delivery time will depend on the complexity of the request and is estimated to take approx. 4-6 weeks after confirmation of the project.

Should it take longer than expected, the buyer will be informed about the delay in a timely manner. If the timeline does not suit the buyer, he/she has 3 working days to cancel his/her order. The amount already paid will be refunded to him/her within 30 days after confirmation.

If the article is no longer available due to raw material shortage or a discontinued collection, the buyer will have an option to either obtain a refund or exchange for a different article.

(Prices)
All prices listed in the online shop are in EURO, including 21% Belgian VAT for customers within Europe. For customers outside of the EU with a delivery address outside the EU, Belgian VAT can be deducted from the prices. Please contact us here for further details.

(Order)
Upon successful order confirmation, the buyer acknowledges full and complete acceptance of the specific sales conditions displayed in their cart during checkout, which include:

  • Product name
  • Product price
  • Product specifications
  • Quantity
  • Shipping costs

TAYO, in return, acknowledges receipt of the order via email. This confirmation includes:

  • The article(s) purchased
  • Price in € of the article(s) purchased
  • Price in € of the shipping costs

(Security of Payments)
TAYO utilizes an SSL certificate on our website to ensure that all online card purchases are as secure as possible. This means that the buyer's information is transmitted through a secure connection, protecting the buyer's card details from being accessed by external parties.

(Non-Payments)
TAYO reserves the right to cancel or suspend any order and/or delivery in the event of non-payment or an existing commercial dispute with the buyer.

(Shipping Costs)
Delivery costs are clearly indicated during checkout when the buyer finalizes the order. These costs cannot be contested by the buyer once the order has been paid for.

The shipping costs depend on the customer’s location: 

  • Secured shipping in Belgium: 10.00 Euro
  • Free shipping in Belgium from 250 Euro purchased
  • Secured shipping in France, Netherland, Germany : 20.00 Euro 

(Shipping arrangements)
TAYO will deliver the goods ordered by the customer to the address provided by the customer at the time of the order. Delivery to post office boxes is not possible.

Delivery dates are non-binding unless expressly agreed upon. TAYO reserves the right to deliver any order in parts if such a method is deemed suitable for expedited delivery. In the event that delivery becomes impossible, TAYO will promptly inform the customer.

TAYO shall have no liability to the customer for any failure to deliver the ordered goods, any delay in delivery, or any damage, except in cases of intent or gross negligence on the part of TAYO.

(Conformity)
The buyer acknowledges that they have reviewed all information related to the product before making a purchase. Since the items are handcrafted, each piece is unique and may not perfectly match the photos displayed on the website. Product characteristics may vary slightly from one item to another, and these variations cannot be used as grounds for rejecting a delivered product.

The photographs featured in the online catalog are not binding and may be altered at any time. TAYO cannot be held responsible for a photograph that does not accurately represent the jewelry and/or an incorrect photograph. TAYO only guarantees that the delivered products correspond to the textual description provided on the website.

(Return & exchange policy)
The customer has the right, within a period of 14 days from the date of receiving the original order, to request an exchange or return of the purchased goods by contacting us via email at hello@tayojewelry.com. The goods must be returned in their original packaging to the following address: TAYO - Camille Pennequin, 38 Rue Alphonse Renard, 1050 Brussels, Belgium

If the above-mentioned conditions are met, TAYO will process a new order for the goods to be exchanged and ship them to the delivery address provided in your original order, subject to stock availability.

Items offered at reduced prices, customized items, and items produced upon request are not eligible for the right to cancel the contract.

(Intellectual property)
All elements on our website (e.g., textual, graphic, phonographic, photographic, and electronic data), as well as the displayed articles, are the property of TAYO and are protected by intellectual property laws. Any act of reproduction or transmission, except for exceptions exhaustively recognized by the law, and unless there is explicit written permission from TAYO, is prohibited and subject to civil and criminal penalties.

(Guarantee)
Goods delivered by TAYO come with a two-year warranty, covering damage caused by manufacturing defects or material defects. Our warranty does not cover damage resulting from improper use or the loss of item(s).

We also offer a repair service for our customers, subject to a fee that varies depending on the type of repair needed. For more information or any questions about this service, please contact us here.

(Updated to the terms & conditions)
It remains the responsibility of the buyer to review our general terms and conditions of sale online, which take precedence over any other contractual conditions. Any modifications to the general terms and conditions of sale can be challenged by the buyer within 72 hours of their publication online.

(Claims)
Any claim regarding an online purchase must be made within 48 hours of receiving the order, or it will be legally inadmissible. All claims must be submitted via email to hello@tayojewelry.com and should include the reference of the specific item in question along with the precise reasons for the dispute.

(Liability)
TAYO's liability, regardless of the nature of the damage, will be limited to the total amount of the order. In cases of non-performance, TAYO's liability cannot be invoked if the non-performance of the sales contract or its poor execution is attributable either to the buyer, an unpredictable and insurmountable event involving a third party unrelated to the sale, or a case of force majeure.

(Proof)
Computer records or logs processed by TAYO (e.g., order records, electronic communications, payments, etc.) are considered valid evidence between the parties

(Indivisibility)
If any of these provisions is invalidated due to the application of a law, regulation, or a final court decision, the parties agree that the remaining provisions will continue to be fully applicable.

(Disputes)
These online terms and conditions of sale are governed by Belgian law. In the event of a dispute, the courts of Brussels have jurisdiction, subject to mandatory legal provisions. The buyer is also informed about the existence of the European Online European ODR Platform. This platform aims to assist in resolving online disputes arising from contracts made online between a buyer and a seller. It provides the buyer with methods for amicable dispute resolution and is operated by entities qualified to handle disputes between consumers and businesses or professionals located within the European Union.
